TERMS OF SERVICE

SmallBizPages Terms of Service for Your Personal Use Welcome to fastest directory listing! By using SmallBizPages’s directory listing or other SmallBizPages services (“SmallBizPages Services”), you agree to be bound by the following terms and conditions (the “Terms of Service”). We occasionally modify these policies, so please check back here for any updates

 

  • Illegal Activities

    Do not use our Services to engage in illegal activities or to promote activities that are dangerous and illegal, such as terrorism, the sale of illegal drugs, or human trafficking.

    We may also remove content that violates applicable local laws. To report content that you believe should be removed based on local laws, click here.

  • Malicious and Deceptive Practices

    Do not transmit viruses, malware, or any other malicious or destructive code. Do not distribute content that harms or interferes with the operation of the networks, servers, or other infrastructure of Google or others. Do not use our Services for phishing scams.

  • Hate Speech

    Our products are platforms for free expression. But we don’t support content that promotes or condones violence against individuals or groups based on race or ethnic origin, religion, disability, gender, age, nationality, veteran status, or sexual orientation/gender identity, or whose primary purpose is inciting hatred on the basis of these core characteristics. This can be a delicate balancing act, but if the primary purpose is to attack a protected group, the content crosses the line.

  • Harassment, Bullying, and Threats

    Do not engage in harassing, bullying, or threatening behavior, and do not incite others to engage in these activities. Anyone using our Services to single someone out for malicious abuse, to threaten someone with serious harm, to sexualize a person in an unwanted way, or to harass in other ways may have the offending content removed or be permanently banned from using the Services. In emergency situations, we may escalate imminent threats of serious harm to law enforcement. Keep in mind that online harassment is also illegal in many places and can have serious offline consequences for both the harasser and the victim.

  • Personal and Confidential Information

    Do not distribute other people’s personal and confidential information, such as credit card numbers, confidential national ID numbers, or account passwords, without their permission. Do not post or distribute images or videos of minors without the necessary consent from their legal representatives. Report a violation

  • Child Exploitation

    Do not upload or share content that exploits or abuses children. This includes all child sexual abuse imagery (even cartoon images) and all content that presents children in a sexual manner. We will remove such content and take appropriate action, which may include disabling accounts and reporting to the National Center for Missing & Exploited Children (NCMEC) and law enforcement. Note that this policy may additionally apply to any content uploaded or transmitted through our Services.

    If you find any content that you think exploits children in this manner, do not +1, reshare or comment on such content, even if your intent is to bring it to Google’s attention. Instead, flag the content through the ‘Report Abuse’ link. If you find content elsewhere on the internet, please contact NCMEC directly.

  • Spam

    Do not spam, including by sending unwanted promotional or commercial content, or unwanted or mass solicitation.

    Do not aggressively send invitations, add people to your circles, or message people that you do not know.

  • Ranking Manipulation

    Do not manipulate ranking or relevancy using techniques like repetitive or misleading keywords or metadata.

  • Sexually Explicit Material

    Do not distribute sexually explicit or pornographic material. Do not drive traffic to commercial pornography sites.

    We do allow naturalistic and documentary depictions of nudity (such as an image of a breastfeeding infant), as well as depictions of nudity that serve a clear educational, scientific, or artistic purpose.

    Note that your Google+ profile photo cannot include mature or offensive content. For example, do not use a photo that is a close-up of a person’s buttocks or cleavage.

  • Violence

    Do not distribute depictions of graphic or gratuitous violence.

  • Regulated Goods and Services

    Our Services enable discussion of many topics, but we do not allow content that facilitates the sale of regulated products and services, including alcohol, gambling, pharmaceuticals and unapproved supplements, tobacco, fireworks, weapons, or health/medical devices.

    Because these topics are often heavily regulated and may not be appropriate for all ages or in all countries, we have created tools on Google+ to help you target your content to users of the appropriate ages in the right markets. If your content promotes regulated goods and services, you are responsible for applying the appropriate age and geographical restrictions for that content where these tools are available. If we receive a complaint that such content is targeting audiences in violation of applicable laws and regulations, we may remove or restrict the offending content or account.

    Even with the appropriate age and geographical restrictions in place, we still do not allow the facilitation of the sale of the products listed above.

  • Impersonation

    Do not use our Services to mislead or confuse users by pretending to be someone else or pretending to represent an organization you do not represent. Some products have additional guidelines: Learn moreabout Impersonation on Google+.

  • Account Hijacking

    Do not access another user’s account without their permission.

 

Content Linked to by SmallBizPages

The sites displayed as search results or linked to by SmallBizPages Services are developed by people over whom SmallBizPages exercises no control. The search results that appear from SmallBizPages’s database are indexed by automated machinery and computers, and SmallBizPages cannot and does not screen the sites before including them in the database from which such automated search results are gathered. A search using SmallBizPages Services may produce search results and links to sites that some people find objectionable, inappropriate, or offensive. We cannot and do not guarantee that a SmallBizPages search will not locate unintended or objectionable content and assume no responsibility for the content of any site included in any search results or otherwise linked to by the SmallBizPages

Services.

Personal Use Only

The SmallBizPages Services are made available for your personal, non-commercial use only. You may not use the SmallBizPages Services for any commercial use, including but not limited to selling products or services, or to increase traffic to your Web site for commercial reasons of any kind whatsoever. You may not take the results from a SmallBizPages search and reformat and display them, or mirror the SmallBizPages home page or results pages on your Web site. You may not “meta-search” SmallBizPages. If you want to make commercial use of the SmallBizPages Services, you must enter into an agreement with SmallBizPages to do so in advance. No Automated Querying

You may not send automated queries of any sort to SmallBizPages’s system without express permission in advance from SmallBizPages. Note that “sending automated queries” includes, among other things:

using any software which sends queries to SmallBizPages to determine how a website or webpage “ranks” on SmallBizPages for various queries; “meta-searching” SmallBizPages; and performing “offline” searches on SmallBizPages.

Please do not write to SmallBizPages to request permission to “meta-search” SmallBizPages for a research project, as such requests will not be granted.

No website links or e-mail links on company name & company descriptions for Free Listing.

Your listing will be rejected or removed if you have website links or e-mail links on company name & descriptions for free listing. If you wish to have the features, you can upgrade your listing to a paid listing by login in to your account and click deluxe or premium listing button. Changes In Terms and Conditions and SmallBizPages Search Service

SmallBizPages may alter or terminate our services from time to time, for any reason, and without notice. If we do so, it is without liability to you, any other user or any third party. We reserve the right to modify these Terms of Service from time to time for any reason, without notice and without liability to you , any other user or any third party. Please review these Terms of Service from time to time so that you will be informed of any changes.

Disclaimer of Warranties

SmallBizPages disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, operability or availability of information or material displayed in the SmallBizPages SERVICES results. SmallBizPages disclaims any responsibility for the deletion, failure to store, misdelivery, or untimely delivery of any information or material. SmallBizPages disclaims any responsibility for any harm resulting from downloading or accessing any information or material on the Internet through the SmallBizPages SERVICES.

THE SmallBizPages SERVICES, AND ALL MATERIALS, INFORMATION, PRODUCTS AND SERVICES INCLUDED IN THE SmallBizPages SERVICES ARE PROVIDED “AS IS,” WITH NO WARRANTIES WHATSOEVER. UNDER NO CIRCUMSTANCES SHALL SmallBizPages OR ITS LICENSORS BE LIABLE TO ANY USER ON ACCOUNT OF THAT USER’S USE OR MISUSE OF OR RELIANCE ON THE SmallBizPages SERVICES ARISING FROM ANY CLAIM RELATING TO THIS AGREEMENT OR THE SUBJECT MATTER HEREOF. SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, (EVEN IF SmallBizPages OR ITS LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON THE SmallBizPages SERVICES, FROM INABILITY TO USE THE SmallBizPages SERVICES, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SmallBizPages SERVICES (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES). THIS LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE SmallBizPages SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE SmallBizPages SERVICES, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON THE SmallBizPages SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE SmallBizPages SERVICES. THIS LIMITATION SHALL ALSO APPLY, WITHOUT LIMITATION, TO THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, OR LOST DATA. SUCH LIMITATION SHALL FURTHER APPLY WITH RESPECT TO THE PERFORMANCE OR NON-PERFORMANCE OF THE SmallBizPages SERVICES OR ANY INFORMATION OR MERCHANDISE THAT APPEARS ON, OR IS LINKED OR RELATED IN ANY WAY TO, THE SmallBizPages SERVICES. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW.

SOME PROVINCES MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Without limiting the foregoing, under no circumstances shall SmallBizPages or its licensors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Requests for Removal of Links or Cached Materials

SmallBizPages may from time to time receive requests from people to remove links from its indices. Although SmallBizPages reserves the right to address such requests individually, the general approach that SmallBizPages takes reflects the following principles:

SmallBizPages’s indices consist of information that has been identified, indexed and compiled through an automated process with no advance review by human beings. Given the enormous volume of web site information added, deleted, and changed on a frequent basis, SmallBizPages cannot and does not screen anything made available through its indices. For each web site reflected in SmallBizPages’s indices, if either (i) a site owner restricts access to his or her web site or (ii) a site is taken down from the web, then, upon receipt of a request by the site owner or a third party in the second instance, SmallBizPages would consider on a case-by-case basis requests to remove the link to that site from its indices. However, if the operator of the site does not take steps to prevent it, the automatic facilities used to create the indices are likely to find that site and index it again in a relatively short amount of time.

SmallBizPages may store many web pages to retrieve for users as a back-up in case the page’s server temporarily fails. Site owners may block SmallBizPages from returning cached versions of their pages by using the NOARCHIVE meta-tag. Site owners may also request immediate removal of cached page from the SmallBizPages Search Service. SmallBizPages evaluates such requests for the immediate removal of cached content on a case-by-case basis and does not guarantee that every request will be granted. Miscellaneous Provisions

These Terms of Service will be governed by and construed in accordance with the laws of the Province of Ontario, without giving effect to conflict of laws provisions or your actual province or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by SmallBizPages.
